一年前,美国OpenAI公司推出了一款强大的人工智能助手——ChatGPT3.5版。令人遗憾的是,我国的一些企业已经抢先一步,注册并使用了“ChatGPT”这一商标,其中一些企业甚至已经通过了商标局的初步审查,进入了公告流程。然而,如果OpenAI公司想要维护自己的权益,并非易事。原因在于,OpenAI公司并未在我国向用户开放ChatGPT,因此,它自身申请的商标也存在着被挑战的风险。今天,我们就来探讨一下这个话题。
下图是笔者初步查询到的目前CHATGPT的注册及公告情况:
如果OpenAI试图阻止那些已获得注册或初步审查通过、正处于公告阶段的ChatGPT商标,将会因自身原因或商标所属类别而遭遇复杂 legal issues。
一、OpenAI在国内没有对ChatGPT做商标性使用
尽管OpenAI尚未向中国用户开放ChatGPT服务,但我国用户仍可通过其他途径体验其强大功能。事实上,只要使用软件修改IP地址,就可以访问ChatGPT。但要注意的是,这种方法需要注册账号,而注册过程需要海外手机验证。因此,为了注册,国内用户必须依赖国外手机号或通过国外短信接码平台接收验证码。值得注意的是,ChatGPT3.5版本是免费的,但如果要使用功能更强大的ChatGPT4.0,用户需要拥有海外信用卡并接受更为严格的IP地址审核程序。
ChatGPT没有对中国用户开放,也就意味着OpenAI在国内没有对ChatGPT这个商标有法律意义上的商标性使用。此时,打击抢注最常规的手段——我国《商标法》第三十二条后半款“不得以不正当手段抢先注册他人已经使用并有一定影响的商标”,这个武器就没法使用,因为这个条款的使用指的是在中国国内使用。
二、已经注册或通过初审的商标均不在人工智能相关类别
在2023年3月,OpenAI在我国申请了“ChatGPT”商标,该商标的申请类别包括第9类计算机软硬件以及第42类人工智能研究、技术咨询等。然而,如前所述,目前通过注册或初步审查的商标类别为第5类医药、第7类机械设备、第8类手工器械、第10类医疗器械、第11类灯具空调、第12类运输工具、第13类军火烟火、第15类乐器、第18类皮革皮具、第32类啤酒饮料、第39类运输贮藏等,这些类别与OpenAI所使用的ChatGPT类别并不相同。因此,如果OpenAI想要主张商标的跨类保护,将会遇到驰名商标法律规定不支持的问题。根据我国《商标法》第十三条的规定,驰名商标的保护标准有两个主要方面。首先,对于能够在消费者中产生广泛影响,使得相关公众容易产生混淆的商标,可以被认定为驰名商标。其次,即使他人已经在一定范围内使用了相同的商标,只要该使用者的商品与商标注册人的商品存在一定的区别,或者该使用者的商品并非用于商业活动,那么该商标就不构成侵权。这两个标准都表明,驰名商标的保护并不是无条件的,而是需要满足一定的条件和经过一定的程序。
在我国,已注册的驰名商标若遭受他人的复制、模仿或翻译等行为,导致公众误解,从而可能损害商标持有者的利益,那么他们便有权申请跨类保护。
在我国,对于未经注册的驰名商标,其保护范围仅限于在相同或相似的商品上。如果该商标被他人复制、模仿或翻译,可能会引发消费者混淆,因此在我国对其保护是有限的。
而OpenAI公司的“ChatGPT”并未获中国注册,所以不能跨类保护。同时,我国认定驰名商标,无论在国家知识产权局还是法院的司法认定,都要求就相关公众对该商标的知晓程度、该商标使用的持续时间、该商标的任何宣传工作的持续时间、程度和地理范围、该商标作为驰名商标受保护的记录、该商标驰名的其他因素进行举证,并且这些证据都应当是在中国国内有影响力的证据。
所以这里面有两个问题,一个是OpenAI公司的ChatGPT品牌本来知名度只是在IT产业比较高,去年底因为ChatGPT3.5的推出才火到圈外的,知名度建立的时间比较短。同时其屏蔽中国用户,导致其在国内的知名度也不够高。根据国内的法规,如果在先商标仅仅在其他国家、地区等具有较高知名度,但依据诉争商标申请日前的实际使用情况,不能为中国境内相关公众所熟知的,也不能被认定为驰名商标。所以OpenAI公司要利用驰名商标保护规则维权已经注册或通过初审的ChatGPT商标,难度极大。
三、部分通过初审的商标侵犯OpenAI的LOGO著作权
上图是OpenAI公司的LOGO,这个LOGO如果是人工设计而非人工智能生成的,属于美术作品,受《著作权法》保护。笔者注意到,部分通过初审的ChatGPT商标将该LOGO作为了商标的图形,根据我国《商标法》第三十二条第一款规定,申请商标注册不得损害他人现有的在先权利
原内容为:著作权是一种先权利,这一原则也适用于OpenAI。因此,当有人试图侵犯OpenAI的商标权时,OpenAI可以依据著作权法进行维权。下面详细介绍ChatGPT所设计的LOGO设计思路。
有朋友可能会问,OpenAI是外国公司,我国也保护其著作权吗?答案是肯定的,我国和美国均为《保护文学和艺术作品伯尔尼公约》缔约国,故互相保护对方国民的著作权。根据最高院商标确权司法解释,如果OpenAI认定其LOGO为《著作权法》意义上的美术作品的,其应当提供著作权归属的初步证据,如涉及商标标志的设计底稿、原件、取得权利的合同、诉争商标申请日之前的著作权登记证书等作为证明。
四、部分申请人涉嫌囤积商标
笔者关注到, ChatGPT这一热词在国内引发了不少企业的商标申请热潮。部分企业甚至针对多个类别进行了同名的商标申请。若这些申请并非出于实际使用需求,那么OpenAI公司可能会因涉嫌囤积商标、违反诚实信用原则以及扰乱正常商标注册管理秩序而向国家知识产权局提出申诉,请求阻止或撤销这些商标。法律依据来自《商标法》第四条第一款的第二句,对于不是用于实际使用的恶意商标注册申请,相关部门有权拒绝。
五、OpenAI申请的ChatGPT商标有点悬
前文已述,OpenAI在我国申请了第9、42类的“ChatGPT”商标。ChatGPT一词本身有自然含义用在人工智能相关服务的显著性较弱,这可能会给OpenAI在国内的申请造成很大的麻烦。
ChatGPT为英文Chat Generative Pre-trained Transformer的缩写,意为:聊天生成预训练Transformer,而Transformer则是深度学习中的三种常用的特征提取网络结构之一,另两种是CNN、RNN。也就是说,ChatGPT这个词是一种人工智能服务模式描述的缩写。
所以,哪怕OpenAI公司的“ChatGPT”商标申请在第9和42类通过审查获得注册的。任何人都可以以这个名称不具有显著性对其提起无效,根据《商标法》第十一条,仅直接表示商品的质量、主要原料、功能、用途、重量、数量及其他特点的标志不得作为商标注册。如果可以证明该名称不具有显著性,国家知识产权局是有可能对其无效的。
但具有讽刺意味的是,ChatGPT一词用到本文之前提到的医药、机械等十多个其他类别上,倒是具有显著性的,到时候OpenAI自己的“ChatGPT”商标被无效,他人在其他类别上申请的“ChatGPT”商标倒是可以继续获得注册,这就比较讽刺了。
究其原因,还是使用证据问题,如果OpenAI按我国的合规流程,为ChatGPT做人工智能算法备案,在国内进行使用,那其将凭借出色的技术能力获得较高的声誉,此时,其说不定可以依据《商标法》第十一条第二款的规定“仅直接表示商品的质量、主要原料、功能、用途、重量、数量及其他特点的标志,经过使用取得显著特征,并便于识别的,可以作为商标注册”而获得商标注册。
综上,虽然OpenAI作为ChatGPT的发明人,打击他人搭便车的抢注行为有一定的正当性,但由于其未在中国国内就ChatGPT有相应的使用行为,所以商标保护困难很大。作为ChatGPT的用户,笔者还是希望其能早日进入中国运营,让国内用户能通过正常访问途径就可以体验全球领先的人工智能服务。
